This privacy policy (the “Privacy Policy”) applies to personal information collected and used by and disclosed to and by Landus Ag ULC (“Landus Canada”, “we”, “us” or “our”) or our affiliate Landus Cooperative (together with Landus Canada, “Landus”) for the purposes of completing online and offline transactions between you and Landus Canada. We have created this Privacy Policy to share with you what information Landus Canada collects, how we use that information, and who we will share that information with, if at all. This Privacy Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. We encourage you to read this Privacy Policy and to use the information it contains to help you make informed decisions.

To the extent that you use and access the Landus Cooperative website and/or the Landus Cooperative Customer Digital Platform, including both the web and mobile application, owned and operated by Landus Cooperative, your use and the collection, use, and disclosure of your personal information and other information in connection with the Landus Cooperative website and/or the Landus Cooperative Customer Digital Platform will also be subject to the Landus Cooperative customer digital experience privacy policy, which is available at https://www.landus.ag/privacy-policy.

1. INFORMATION WE COLLECT OR RECEIVE

We collect, use, and disclose personal information to operate our business and as required by law. Personal information is information about an identifiable individual, or any information that identifies you as an individual, as defined in the Canadian Personal Information Protection and Electronic Documents Act and in any applicable provincial legislation (collectively, the “Privacy Acts”). It includes information that you provide to Landus Canada or that Landus Canada collects from any third party.

In the course of completing online and offline transactions between you and Landus Canada, we will collect and/or receive the following types of information, and you authorize us to collect and/or receive such information:

a. Personal Information. We only receive or collect information that identifies you personally if you choose to provide such personally identifiable information to us via email or other means. When you sign up to receive services or goods from Landus Canada, you will be required to provide us with personal information about yourself, which may include contact and biographical information including your first and last name, your email address, your phone number, and your physical address (collectively, “Personal Information”).

b. Payment Information. If you choose to make a purchase or subscribe to a feature or service of ours that requires a fee, you will be required to provide us with your payment information, including, without limitation, bank account numbers, credit card or debit card numbers, account details, ACH information, and similar data (collectively, “Payment Information”). Where applicable, such Payment Information may be disclosed to and processed by our third-party payment vendors pursuant to the terms and conditions of their privacy policies and terms of use, and we do not obtain access to any Payment Information in connection with such purchases.

2. CHANGES TO PRIVACY POLICY

This Privacy Policy describes our current privacy practices. We update this Privacy Policy on an ongoing basis to ensure customers and service providers are aware of updates to our privacy practices, to streamline those practices and to comply with applicable laws. Please visit the Landus website regularly for updates. 

Landus Canada may, at any time and from time to time at its sole discretion, update, revise, supplement, replace, and/or otherwise modify this Privacy Policy and/or impose new or additional rules, policies, terms, or conditions on you. Such updates, revisions, supplements, replacements, modifications, and additional rules, policies, terms, and conditions (collectively referred to as “Revised Terms”) will be effective immediately upon the Revised Terms being posted to the Landus website or by Landus Canada otherwise making them available to you (as the case may be). 

3. HOW INFORMATION IS USED AND SHARED

a. You authorize us to use the Personal Information and the Payment Information (collectively, the “Information”) to:

i. provide and improve our goods and services;

ii. administer our promotional programs;

iii. solicit your feedback; and

iv. inform you about our products and services.

b. In order to provide our services and administer our promotional programs, we may share the Information with our third-party promotional and marketing partners, including, without limitation, businesses participating in our various programs.

c. We engage third-party companies and individuals to perform functions on our behalf. Examples may include providing technical assistance, customer service, marketing assistance, and administration of promotional programs. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by applicable laws.

d. We may share some or all of your Information with any of our subsidiaries, joint ventures, or other companies under common control with us. We may also disclose your Information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors, to the extent that such disclosure is reasonably necessary for the purposes set out in this Privacy Policy.

e. As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Information may be part of the transferred assets.

f. We may use or disclose the Information to deal with inquiries, complaints, submissions and feedback relating to our goods and services.

g. To the extent permitted by law, we may also use or disclose the Information:

i. when required by law, court order, or other government or law enforcement authority or regulatory agency, including to the Canada Revenue Agency, as required by applicable regulatory bodies, to a governmental or other authority to which the disclosure is required under applicable laws, to a court or judicial body determining the rights of the parties under the terms of any agreement between us and you, or as otherwise required or permitted by applicable laws; 

ii. to manage, administer, maintain, service, and enforce this Privacy Policy and verify compliance with agreements between you and us, or to otherwise comply with applicable laws and regulations; or

iii. whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of us or others, including you.

We may use your Personal Information to contact you. Your Personal Information allows us to contact you by various methods, including mail, email, and telephone at the contact points you have provided to us. We will contact you to respond to your questions, proactively provide you with information about our services that you use. When you communicate online or by email, you should be aware that sending information over the internet is inherently insecure, as it can be intercepted or manipulated and retransmitted.

Information that we collect may be uploaded, moved, stored, processed in, backed up and/or transferred between any of the countries in which we operate or may operate in order to enable us to collect, use, and/or disclose the Information in accordance with this Privacy Policy. Your Information may be uploaded, moved, stored, processed in, backed up and/or transferred in Landus Canada’s discretion in Canada or in jurisdictions other than Canada, including the United States, and you consent to the same. You also acknowledge and agree that your Information may be transmitted, uploaded, or moved across international borders in Landus Canada’s discretion, and you consent to the same. Information processed and stored in another country may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws.

You acknowledge and agree that we may use and/or disclose your Information, without notice, if legally permitted to do so according to the relevant provisions of the Privacy Acts. The Privacy Acts may permit the use and/or disclosure of Personal Information without notice if, for example: (a) the Information could be useful in the investigation of a contravention of the laws of Canada, a province of Canada or a foreign jurisdiction; (b) the Information is used or disclosed for the purpose of acting in respect of an emergency that threatens the life, health or security of an individual; and (c) the Information is disclosed to comply with the edicts of the law, or to comply with a subpoena or warrant issued or an order made by a court. 

4. ACCESSING AND MODIFYING INFORMATION PREFERENCES AND WITHDRAWAL

If you have provided us any Personal Information, you may access, remove, review, and/or make changes to the same by contacting us as set forth below. In addition, you may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any of the Landus marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases. 

You may withdraw your consent to the collection, use, and disclosure of your Personal Information as set out in this Privacy Policy at any time. Withdrawal of your consent to the collection, use, and/or disclosure of your Personal Information as set out in this Privacy Policy may result in all or part of our goods or services being unavailable to you. If you withdraw your consent to the collection, use, and/or disclosure of your Personal Information as set out in this Privacy Policy, Landus Canada reserves the right to limit your access or prevent you from accessing our related goods or services.

5. HOW WE PROTECT YOUR INFORMATION

We take commercially reasonable steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

Access to your Information is restricted to those individuals and parties who require access for the purposes set out in this Privacy Policy. Landus Canada may secure the Information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When Information is transmitted to other web sites or third parties for the purposes specified above, we may also, or in the alternative, protect it through the use of encryption, such as by way of the Secure Socket Layer (SSL) protocol.

Information is not kept by Landus Canada for any longer than is necessary for the purposes identified in this Privacy Policy. Information that is no longer required to fulfil the purposes identified in this Privacy Policy will be destroyed, erased, or made anonymous.

6. ACCURACY

We take steps to ensure that your Information is as accurate, complete and up to date as is necessary for the purposes for which it is to be used. If you believe that the Information we have about you is not accurate or is incomplete, please contact us about updating your Information by email at communications@landus.ag with “Privacy Policy” in the subject line. If you move, change your phone number, or change your email address, you are required to update your information with us.

7. OPENNESS, INDIVIDUAL ACCESS AND CHALLENGING COMPLIANCE

You can write to Landus to request access to the Information we have on file for you. We will provide you with the Information we have, subject to certain considerations specified by law. If you wish to request access to the Information that we have on file for you, or request that such Information be corrected, please contact Landus’s designated Privacy Officer at communications@landus.ag with “Privacy Policy” in the subject line or mail us at the following address: 220 SW 9th St., Ste. 300 Des Moines, IA 50309-4320.

Landus Canada welcomes your comments regarding this Privacy Policy. If you would like more information on this Privacy Policy or Landus’s organizational privacy policies, or if believe that Landus Canada has not adhered to the terms of this Privacy Policy, please contact Landus’s designated Privacy Officer at communications@landus.ag with “Privacy Policy” in the subject line or mail us at the following address: 220 SW 9th St., Ste. 300 Des Moines, IA 50309-4320. We will use commercially reasonable efforts to promptly identify and remedy any failure by Landus Canada to adhere to the terms of this Privacy Policy.
